Terms & Conditions

1.1. Scope and acceptance

These Terms govern use of https://gemeraldgems.com and purchases from Gemerald Collection Ltd. (Gemerald). Customers must actively accept these Terms at checkout using a mandatory box that is not preselected. The Shipping & Delivery Policy, Returns, Refunds & Cancellation Policy, and Privacy Policy are incorporated by reference. Nothing limits mandatory rights under applicable law.

2.2. Our products and descriptions

Gemerald sells natural emerald gemstones, including stones described as originating from Zambia, to consumers and trade customers. Each gemstone is unique; natural inclusions, color variation and differences between screen images and actual appearance may occur. Product listings must accurately describe the particular stone, including its stated weight, dimensions, origin where substantiated, and known treatments. Natural emeralds may have undergone oil treatment; treatment information must be disclosed accurately on the individual listing and accompanying documents.

3.3. Certificates

Gemerald provides its own gemstone certificate or identification document for purchased stones. Such documents are issued by Gemerald, not an independent gemological laboratory. A third-party laboratory report is supplied only where specifically described and identified as such. Customers should review the product listing and request clarification before purchase.

4.4. Availability, ordering and acceptance

Gemstones are individually stocked and listed only while available. Submission of an order and automated receipt acknowledgment do not necessarily constitute acceptance. An order is accepted when Gemerald sends its express acceptance confirmation, following payment approval and any reasonable fraud, legal or delivery checks. If a stone is unavailable or Gemerald cannot accept an order, we will promptly notify the customer and refund the entire amount paid to the original payment method; no substitute stone will be supplied without consent. Checkout messages and payment capture must reflect this process.

5.5. Pricing and payment

Prices are displayed in USD unless otherwise stated. The customer must be shown the complete amount charged by Gemerald, including the individually calculated shipping fee and applicable taxes charged by Gemerald, before authorizing payment. Payments are facilitated through PayPlus and MAX, as applicable. Gemerald does not intentionally store complete payment card numbers or security codes in its own website database. Destination-country import duties and charges may be payable separately as disclosed in the Shipping & Delivery Policy.

6.6. Delivery

Gemerald arranges secure shipment through Malca-Amit, Ferrari Group, FedEx or another suitable provider. Standard estimated delivery is 5–10 business days and the anticipated timeframe is no more than 14 business days, measured from order acceptance, approved payment and completion of necessary compliance and shipment arrangements, subject to carrier, customs and other delays. These are estimates, not unconditional guarantees. See the Shipping & Delivery Policy for charges, delays, loss and import issues.

7.7. Cancellations and returns

Eligible standard gemstones may be returned by requesting cancellation within 14 calendar days after delivery, or a longer period where required by applicable law. Special statutory starting dates and extended cancellation periods may apply. Gemerald coordinates secure returns, with customer-paid return shipping for ordinary change-of-mind returns only where lawful. Inspection and damage claims are subject to applicable law. Full details are in the Returns, Refunds & Cancellation Policy.

8.8. Custom-cut gemstones

Custom cutting requires express customer approval of specifications, pre-cut weight pricing, final price, and applicable cancellation terms before cutting starts. Custom-made products may be excluded from voluntary change-of-mind returns only where legally permitted. Mandatory rights for defects, misdescription, nonconformity and legally protected pre-production cancellation remain unaffected.

9.9. Responsibilities and customer conduct

Gemerald is responsible for reasonable accuracy of listings, processing accepted orders, arranging agreed delivery, customer service and remedies required by law for nonfulfillment. Customers must provide correct billing, delivery and customs information and must not misuse the website or submit fraudulent transactions. Gemerald does not guarantee uninterrupted website operation, but does not exclude liabilities that cannot legally be excluded.

10.10. Intellectual property and privacy

Website photographs, text, logos and other original material belong to Gemerald or their licensors and may not be commercially reproduced without authorization, except as permitted by law. Personal data is processed as described in the Privacy Policy and Cookie Policy.

11.11. Changes, disputes and governing law

Changes to these Terms do not retrospectively remove rights associated with accepted orders. Israeli law governs these Terms, without depriving consumers of mandatory protections that apply in their country or jurisdiction. Customers are encouraged to contact Gemerald first to resolve disputes. Any forum or jurisdiction arrangement applies only to the extent lawful.
